Domestic Violence – Interim maintenance

Husband alleging marriage void as wife was previously married – Marriage certificate produced which by itself not sufficient for effective decision with regard to marital status of parties and that too in collateral proceedings for maintenance – In the absence of valid decree of nullity, relationship between parties has to be taken to be of marriage and not in the nature of marriage – Wife is entitled to claim all benefits and protection under the Act.
